Trade Union Workplace Access - A Practical Guide for CBA Members
The Employment Rights Act 2025 introduces significant changes to trade union legislation, including new Workplace Access provisions that give recognised trade unions wider statutory rights of physical and digital access to workplaces for the purposes of recruiting, organising and representing workers.
Whilst many larger organisations already have established relationships with trade unions, these changes may be unfamiliar to many independent bakery businesses. For employers with little or no previous experience of working with a trade union, receiving an approach can feel daunting and raise concerns about what it means for their business.
The purpose of this guide is to explain the new requirements in straightforward terms and provide practical advice on what to do if your business is approached by a trade union. It outlines the key steps to take during the first 48 hours and the process that may follow.
Most importantly, remember that you are not on your own.
Supporting independent bakery businesses through legislative change is one of the key reasons the Craft Bakers Association exists. If your business is approached by a trade union and you are unsure what to do, contact the CBA before taking action. We can provide guidance, explain the process and, where appropriate, put you in touch with members who have experience of working constructively with recognised trade unions.
Many of our members already have positive and productive relationships with trade unions, and their experience can often provide valuable reassurance and practical insight.
Whatever stage you are at, the CBA is here to support you. We've got your back.

Remember
Employees have a legal right to join a trade union, and employers have a legal obligation not to subject employees to detriment because of union membership or activities.
A professional, measured response combined with good employee relations is the best approach when dealing with any union contact.
For further support, please ensure as CBA members you seek advice from our HR support team before responding to any formal recognition request or significant employee relations issue.
